Terms & Conditions

By commissioning Drain Guru to carry work out on your property, you are agreeing to the following terms and conditions.

General

Drain Guru shall be under no liability whatsoever to the Client for any incidental, indirect, special and/or consequential loss, damage and/or expense (including loss of profit and any claims, demands or actions against the Client by any third party) suffered by the Client arising out of a breach by Drain Guru of these terms and conditions, even if Drain Guru should have known the possibility of such damages arising out of, or in relation to its performance or non-performance of this agreement.

The Client shall not, without the prior consent of Drain Guru, be entitled to set off against, or deduct from the Price (by way or counterclaim or other legal or equitable claim), any sums owed or claimed to be owed to the Client by Drain Guru, nor to withhold payment of any invoice because part of that invoice is in dispute.

Drain Guru may license or sub-contract all or any part of its rights and obligations without the Client’s consent.

Neither party shall be liable for any default due to any act of God, war, terrorism, strike, lock-out, industrial action, fire, flood, storm or other event beyond the reasonable control of either party.

Access

As the client, you must ensure that access is provided to all areas of the property needed. If this access is not clear, then either an additional charge may be added on for the time spent trying to gain access, or services for the inaccessible area may not be carried out.

Payment

All jobs require payment to be made within 3 weeks, or 21 days. Where a payment is due on a public holiday, it will be expected on the next working day.

Interest on overdue invoices shall accrue daily from the date when payment becomes due, until the date of payment, at a rate of 3% per calendar month, compounding monthly.

If the client owes Drain Guru any money the Client shall indemnify the Drain Guru from and against all costs and disbursements incurred by the Company in recovering the debt (including but not limited to internal administration fees, legal costs on a solicitor and own client basis, Drain Guru’s collection agency costs, and bank dishonour fees).

Damage of Property

Drain Guru takes no responsibility for damage that occurs through poor maintenance, including, but not limited to, poor paint work, damaged weatherboards, loose bricks, cracks, and so forth.

Where ground needs to be dug up under shrubbery for underground work, we will replant this, however do not guarantee the survival of any plants.
